Forum rules and no-advertising policy

As a participant on this forum, it is your responsibility to know and follow our rules. Please read this message in its entirety.

Board Rules

1. You’re responsible for what you say.
As outlined in Section 230 of the Communications Decency Act, The Chronicle of the Horse and its affiliates, as well Jelsoft Enterprises Ltd., the developers of vBulletin, are not legally responsible for statements made in the forums.

This is a public forum viewed by a wide spectrum of people, so please be mindful of what you say and who might be reading it—details of personal disputes are likely better handled privately. While posters are legally responsible for their statements, the moderators may in their discretion remove or edit posts that violate these rules. Users have the ability to modify or delete their own messages after posting, but administrators generally will not delete posts, threads or accounts upon request.

Outright inflammatory, vulgar, harassing, malicious or otherwise inappropriate statements and criminal charges unsubstantiated by a reputable news source or legal documentation will not be tolerated and will be dealt with at the discretion of the moderators.

Credible threats of suicide will be reported to the police along with identifying user information at our disposal, in addition to referring the user to suicide helpline resources such as 1-800-SUICIDE or 1-800-273-TALK.

2. Conversations in horse-related forums should be horse-related.
The forums are a wonderful source of information and support for members of the horse community. While it’s understandably tempting to share information or search for input on other topics upon which members might have a similar level of knowledge, members must maintain the focus on horses.

3. Keep conversations productive, on topic and civil.
Discussion and disagreement are inevitable and encouraged; personal insults, diatribes and sniping comments are unproductive and unacceptable. Whether a subject is light-hearted or serious, keep posts focused on the current topic and of general interest to other participants of that thread. Utilize the private message feature or personal email where appropriate to address side topics or personal issues not related to the topic at large.

4. No advertising in the discussion forums.
Posts in the discussion forums directly or indirectly advertising horses, jobs, items or services for sale or wanted will be removed at the discretion of the moderators. Use of the private messaging feature or email addresses obtained through users’ profiles for unsolicited advertising is not permitted.

Company representatives may participate in discussions and answer questions about their products or services, or suggest their products on recent threads if they fulfill the criteria of a query. False "testimonials" provided by company affiliates posing as general consumers are not appropriate, and self-promotion of sales, ad campaigns, etc. through the discussion forums is not allowed.

Paid advertising is available on our classifieds site and through the purchase of banner ads. The tightly monitored Giveaways forum permits free listings of genuinely free horses and items available or wanted (on a limited basis). Items offered for trade are not allowed.

Advertising Policy Specifics
When in doubt of whether something you want to post constitutes advertising, please contact a moderator privately in advance for further clarification. Refer to the following points for general guidelines:

Horses – Only general discussion about the buying, leasing, selling and pricing of horses is permitted. If the post contains, or links to, the type of specific information typically found in a sales or wanted ad, and it’s related to a horse for sale, regardless of who’s selling it, it doesn’t belong in the discussion forums.

Stallions – Board members may ask for suggestions on breeding stallion recommendations. Stallion owners may reply to such queries by suggesting their own stallions, only if their horse fits the specific criteria of the original poster. Excessive promotion of a stallion by its owner or related parties is not permitted and will be addressed at the discretion of the moderators.

Services – Members may use the forums to ask for general recommendations of trainers, barns, shippers, farriers, etc., and other members may answer those requests by suggesting themselves or their company, if their services fulfill the specific criteria of the original post. Members may not solicit other members for business if it is not in response to a direct, genuine query.

Products – While members may ask for general opinions and suggestions on equipment, trailers, trucks, etc., they may not list the specific attributes for which they are in the market, as such posts serve as wanted ads.

Event Announcements – Members may post one notification of an upcoming event that may be of interest to fellow members, if the original poster does not benefit financially from the event. Such threads may not be “bumped” excessively. Premium members may post their own notices in the Event Announcements forum.

Charities/Rescues – Announcements for charitable or fundraising events can only be made for 501(c)(3) tax-exempt organizations. Special exceptions may be made, at the moderators’ discretion and direction, for board-related events or fundraising activities in extraordinary circumstances.

Occasional posts regarding horses available for adoption through IRS-registered horse rescue or placement programs are permitted in the appropriate forums, but these threads may be limited at the discretion of the moderators. Individuals may not advertise or make announcements for horses in need of rescue, placement or adoption unless the horse is available through a recognized rescue or placement agency or government-run entity or the thread fits the criteria for and is located in the Giveaways forum.

5. Do not post copyrighted photographs unless you have purchased that photo and have permission to do so.

6. Respect other members.
As members are often passionate about their beliefs and intentions can easily be misinterpreted in this type of environment, try to explore or resolve the inevitable disagreements that arise in the course of threads calmly and rationally.

If you see a post that you feel violates the rules of the board, please click the “alert” button (exclamation point inside of a triangle) in the bottom left corner of the post, which will alert ONLY the moderators to the post in question. They will then take whatever action, or no action, as deemed appropriate for the situation at their discretion. Do not air grievances regarding other posters or the moderators in the discussion forums.

Please be advised that adding another user to your “Ignore” list via your User Control Panel can be a useful tactic, which blocks posts and private messages by members whose commentary you’d rather avoid reading.

7. We have the right to reproduce statements made in the forums.
The Chronicle of the Horse may copy, quote, link to or otherwise reproduce posts, or portions of posts, in print or online for advertising or editorial purposes, if attributed to their original authors, and by posting in this forum, you hereby grant to The Chronicle of the Horse a perpetual, non-exclusive license under copyright and other rights, to do so.

8. We reserve the right to enforce and amend the rules.
The moderators may delete, edit, move or close any post or thread at any time, or refrain from doing any of the foregoing, in their discretion, and may suspend or revoke a user’s membership privileges at any time to maintain adherence to the rules and the general spirit of the forum. These rules may be amended at any time to address the current needs of the board.

    Probably no one will do anything and the other states that they passed thru would have to prosecute them. One GA horse has a coggins from Tenn, btw.
    Each state they passd thru could have gotten them if they violated their health certificate laws, but only Florida down around here really stops people and enforces the law. Since no one stopped them, apparently, and they stopped in Nebraska to pick up the 3rd horse, we are not going to see anyone go after them. Rats, I'm bummed out. And the SO isn't open till Monday for adminstrative purposes. Now to get off the BB and track down the 2 deputies and ring them up, if their phones are listed out there.
    Back tomorrow. From elation to now doubt, what a bummer. Oh wait, I know where Saddlehorn is, I lived in Atlanta over 20 years.

      This outcome is so good for my soul. The suffering that animals go through and the indifference of so very many is really overwhelming sometimes. I will remember this for a long time.

      Does anyone know of a link to see how the horses are doing? Or can anyone report on them? After pictures would be great to see them healthy again.

      These folks can get you some updates.

      I had the pleasure of speaking with Prosecutor Bell months before the trial. I have to say, I was never worried that he wouldn't do his very best to get a conviction. I was very, very impressed. Having worked for different attorneys for several years, it isn't difficult to spot the good ones!

          I read the newspaper article, but if they got longer sentences, I'd be thrilled to hear it. I thought they were only tried for misdemeanors, though?

            I have to tell myself that in a way, they didn't get away with it. We know who they are, we know what they look like, we know what they did to the horses, we know where they live, and the local Georgia horse community isn't about to forget.
            Right now, their lives are hopefully turned upside down and disrupted. More local media coverage would be helpful, but I haven't found much.

            Has anyone figured out where the horses came from? If they contacted Cheryl, then I'm guessing the horses were probably purchased at the HWY 20 auction since that facility is just down the road. - that got me thinking about that place and the people running it. I drive past it often, but I don't have enough courage to drive up and see what's going on.

            By the way, I was talking to my vet (Dr. Jim Nash) about the case and he said that he never heard about it. It got me thinking that not enough influential horse people may not know about this.

              Same thing happens here. I thought you meant could the heydons come back and appeal here, sorry I guess I misread.
              We have a court of appeals for these type cases (unless someone raises constitutional issues) and a supreme court for the murders, etc, and for constitutional issues. But except for a few judges on the court of appeals panels, all the judges (and their law clerks who had been there longer than some of the judges, good law clerks are "inherited" in our appellate courts and write a lot of the opinions) are really good (I've argued many times in both courts, and they just want answers and facts, no whining).
              But right after a trial, all the guy does is say, when he's advised by the judge of his constitutional right to appeal, he says "I want an appeal" and then the judge will appoint the public defender, if the guy says he cannot afford the cost of appeal and transcript) and that's how it's done.

              Georgia just doesn't give them an appellate trial with witnesses, how strange of Montana, rats, don't tell the def. lawyers here or they will want one. Now at our "motion for new trial" hearing, witnesses can be produced, but they must be "newly discovered witnesses" or previous witnesses who are "recanting" their testimony.

              In other words, it's never over. I still occasionally got to habeas hearings on my lifers at the state prisons. When guys are sent to prison for one year or "life" (not really life, unfortunately, usually), all they have is time, and they spend it in the law library writing writs and appeals.

              Rats, if these guys only got misdemeanor sentences, even if the judge ran them consecutively, they still (if Montana is like GA) will only be in the county jail, not in the state prison. Rats. Well someone posted one Heydon's address, and there are enough of us in GA who could visit him if he doesn't go to jail. Rats.

              And since I started this thread thinking there was only one other thread, duh, and then realized there were 2 threads going, again: According to senior Heydon (would we believe anything he says under oath?) he bought 2 horses in Roswell at auction, which someone says must be the horse auction place up Hwy 20 in Forsyth Co. near Cumming, GA., we do know that one of those horses had a coggins cert. from Tennessee. Senior Heydon said he bought the 3rd horse in Nebraska, he testified he was born and raised in NEBRASKA , not GA, and he claimed to be an expert on horses, saying he had owned and ridden horses on his place in Nebraska, and had even shod his horses himself in Neb. As stated in reports and testimony, the shoes had been haphazardly nailed on the horses he took to Montana.

              We could abduct them and drop them off in one of the not so nice sections of Atlanta. Or go visit the gators down in the Okefenokee. Of course I'm just kidding. Maybe..............................

                  Two came from Hwy 20. The TN coggins and the GA coggins. The TN was from the Burell Auction in Cleveland, TN. Herman Strayhorn who ran the auction for 17 years moved in July but the auction actually was closed in Jan of 07. Herman just sold horses out of there until he moved to Griffin, GA. He was kind enough to give me two blind horses he couldn't send to slaughter. Yahoo! That's another whole story. One has cateracts, one had squamous cell. Anyway, when Herman left, Burrell from TN and Charles Young, a local horse trader, rented the Hwy 20 place intending to open the auction back up. They had many people there with horses to sell but some paperwork or something wasn't right and the GDA didn't let them have the auction. Now they just sell horses and move them back and forth to TN to make some profit from them. It seems they always have strangles and lots of penicillin. People bring their horses they don't want and give them to them, thinking they'll get a good home. Sad.

                    I sent copies of the article to many people, Pam Martin, WSB, Brooke Baldwin, CNN, AJC, and more. I hope someone picks it up. If one does, others will follow. I tried when they were first arrested. I only saw it in a Roswell paper but Roswell is where they live.

                      Sorry for the misleading.reports by me. I really did call out to Montana, talk to the reporter on the phone and question her over and over about felonies and jail time. The reporter was mistaken, and instead of getting her to repeat her versions to me, I should have called the prosecutor or court clerk. The great reporter is a horse story reporter, not a trial reporter, so she thought they guys got a lot of jail time. Next time I'll go myself and report back.

                      Thanks Cheryl. Hopefully Pam Martin or John Pruitt or Monica Kauffman will do a story on them. Oh who's the guy, Paul forgethislastname, on Channel 11? Maybe he'll do something on it.

                      Sign, those guys are probably home now, laughing at not having to serve time. I hope they have to sell the house in saddlehorn in roswell (is that an ironic street name?) to pay for the costs.

                          I doubt they are laughing. I, too, had hoped they were going to do some time but if they have to pay the fine, pay the horses expenses that is going to hurt them a LOT. Anyone have an estimate on how much money that would be? It was reported that on the recording the senior Hayden was kicking about fifty dollars a day for the clinic so just imagine when he understands how much this whole thing is going to come to.

                              About Jail Time....This was from Jeff in MT.

                              They will be out on bail at least until its heard by the appeals judge, but bail was increased so their bond will be pretty expensive. Fines will be on hold as well but will have to be paid upon completion of the appeals case which they have about a 1% chance of winning anything at. Montana is on a mission right now to come to the modern world of animal abuse so its a very big social and political issue here right now and ALL of our judges form traffic court to the state supreme court are elected officials so they are not about to risk their jobs for these guys. This thing will end up costing them in the area of $30,000.00 plus once the vet and storage bills are added up .

                              I hope Jeff is right!

                                www.cherokeetribune.com, yesterday's paper, I emailed it to DGRH to hopefully post here if she is on line, reports that the Heydons killed 4 horses. The headline, unless they change it says "heydons guilty in death of 4 horses".

                                I almost want this story to stay up without correction, since the horse people in North Georgia might go get the guys.
