Forum rules and no-advertising policy

As a participant on this forum, it is your responsibility to know and follow our rules. Please read this message in its entirety.

Board Rules

1. You’re responsible for what you say.
As outlined in Section 230 of the Communications Decency Act, The Chronicle of the Horse and its affiliates, as well Jelsoft Enterprises Ltd., the developers of vBulletin, are not legally responsible for statements made in the forums.

This is a public forum viewed by a wide spectrum of people, so please be mindful of what you say and who might be reading it—details of personal disputes are likely better handled privately. While posters are legally responsible for their statements, the moderators may in their discretion remove or edit posts that violate these rules. Users have the ability to modify or delete their own messages after posting, but administrators generally will not delete posts, threads or accounts upon request.

Outright inflammatory, vulgar, harassing, malicious or otherwise inappropriate statements and criminal charges unsubstantiated by a reputable news source or legal documentation will not be tolerated and will be dealt with at the discretion of the moderators.

Credible threats of suicide will be reported to the police along with identifying user information at our disposal, in addition to referring the user to suicide helpline resources such as 1-800-SUICIDE or 1-800-273-TALK.

2. Conversations in horse-related forums should be horse-related.
The forums are a wonderful source of information and support for members of the horse community. While it’s understandably tempting to share information or search for input on other topics upon which members might have a similar level of knowledge, members must maintain the focus on horses.

3. Keep conversations productive, on topic and civil.
Discussion and disagreement are inevitable and encouraged; personal insults, diatribes and sniping comments are unproductive and unacceptable. Whether a subject is light-hearted or serious, keep posts focused on the current topic and of general interest to other participants of that thread. Utilize the private message feature or personal email where appropriate to address side topics or personal issues not related to the topic at large.

4. No advertising in the discussion forums.
Posts in the discussion forums directly or indirectly advertising horses, jobs, items or services for sale or wanted will be removed at the discretion of the moderators. Use of the private messaging feature or email addresses obtained through users’ profiles for unsolicited advertising is not permitted.

Company representatives may participate in discussions and answer questions about their products or services, or suggest their products on recent threads if they fulfill the criteria of a query. False "testimonials" provided by company affiliates posing as general consumers are not appropriate, and self-promotion of sales, ad campaigns, etc. through the discussion forums is not allowed.

Paid advertising is available on our classifieds site and through the purchase of banner ads. The tightly monitored Giveaways forum permits free listings of genuinely free horses and items available or wanted (on a limited basis). Items offered for trade are not allowed.

Advertising Policy Specifics
When in doubt of whether something you want to post constitutes advertising, please contact a moderator privately in advance for further clarification. Refer to the following points for general guidelines:

Horses – Only general discussion about the buying, leasing, selling and pricing of horses is permitted. If the post contains, or links to, the type of specific information typically found in a sales or wanted ad, and it’s related to a horse for sale, regardless of who’s selling it, it doesn’t belong in the discussion forums.

Stallions – Board members may ask for suggestions on breeding stallion recommendations. Stallion owners may reply to such queries by suggesting their own stallions, only if their horse fits the specific criteria of the original poster. Excessive promotion of a stallion by its owner or related parties is not permitted and will be addressed at the discretion of the moderators.

Services – Members may use the forums to ask for general recommendations of trainers, barns, shippers, farriers, etc., and other members may answer those requests by suggesting themselves or their company, if their services fulfill the specific criteria of the original post. Members may not solicit other members for business if it is not in response to a direct, genuine query.

Products – While members may ask for general opinions and suggestions on equipment, trailers, trucks, etc., they may not list the specific attributes for which they are in the market, as such posts serve as wanted ads.

Event Announcements – Members may post one notification of an upcoming event that may be of interest to fellow members, if the original poster does not benefit financially from the event. Such threads may not be “bumped” excessively. Premium members may post their own notices in the Event Announcements forum.

Charities/Rescues – Announcements for charitable or fundraising events can only be made for 501(c)(3) tax-exempt organizations. Special exceptions may be made, at the moderators’ discretion and direction, for board-related events or fundraising activities in extraordinary circumstances.

Occasional posts regarding horses available for adoption through IRS-registered horse rescue or placement programs are permitted in the appropriate forums, but these threads may be limited at the discretion of the moderators. Individuals may not advertise or make announcements for horses in need of rescue, placement or adoption unless the horse is available through a recognized rescue or placement agency or government-run entity or the thread fits the criteria for and is located in the Giveaways forum.

5. Do not post copyrighted photographs unless you have purchased that photo and have permission to do so.

6. Respect other members.
As members are often passionate about their beliefs and intentions can easily be misinterpreted in this type of environment, try to explore or resolve the inevitable disagreements that arise in the course of threads calmly and rationally.

If you see a post that you feel violates the rules of the board, please click the “alert” button (exclamation point inside of a triangle) in the bottom left corner of the post, which will alert ONLY the moderators to the post in question. They will then take whatever action, or no action, as deemed appropriate for the situation at their discretion. Do not air grievances regarding other posters or the moderators in the discussion forums.

Please be advised that adding another user to your “Ignore” list via your User Control Panel can be a useful tactic, which blocks posts and private messages by members whose commentary you’d rather avoid reading.

7. We have the right to reproduce statements made in the forums.
The Chronicle of the Horse may copy, quote, link to or otherwise reproduce posts, or portions of posts, in print or online for advertising or editorial purposes, if attributed to their original authors, and by posting in this forum, you hereby grant to The Chronicle of the Horse a perpetual, non-exclusive license under copyright and other rights, to do so.

8. We reserve the right to enforce and amend the rules.
The moderators may delete, edit, move or close any post or thread at any time, or refrain from doing any of the foregoing, in their discretion, and may suspend or revoke a user’s membership privileges at any time to maintain adherence to the rules and the general spirit of the forum. These rules may be amended at any time to address the current needs of the board.

Please see our full Terms of Service and Privacy Policy for more information.

Why would anyone become a vet if they didn't care for animals?? I sure hope that guy's practice goes down after people in his area hear about such irresponsible testimony... who could look at those pictures and hear from the Heydens themselves that this horse had gone down 'several times' previously (let alone to have seen him in person w/ those wounds) and then say that he was just 'fit' like a model????? Horses just don't repeatedly fall down because they are 'fit'. What an unethical moron.

Thanks for keeping us updated - fingers crossed.

Well, if you didn't care for animals except as property or "machines", it would be a lot easier being a vet. A lot less emotional involvement.

                    words from Dorina and Jeff

                    This is from Dorinda.

                    >>Trial went on for three days (and this is a justice of the peace), with six jurors, who then deliberated for two days (the longest the judge had ever seen in his court). Guilty times 21 counts.

The judge then proceeded to admonish the defendants and literally threw the book at them:
All cost paid; relinquishment of horses, $585 fine for each count and SIX years in jail. Each.
                    They immediately appealed.

Which means, basically, that under Montana law (archaic I agree), in probably 8-9 months they will have another trial under a district judge (much bigger deal), with six more jurors and the probability if found guilty of much lower sentences. The district judges just see too much horror go through their courts to give the same type of sentences to misdemeanor crimes.

Meanwhile our prosecutor, the many witnesses for the prosecution, the six jurors and the judge are heroes. As are Dawn Merrill, Mike Svaboda and Q and Jay DeHart, the people who found and rescued Able. The courtroom and a second courtroom with video were packed all three days and much good have come out of the horror these four horses faced with the Heydons.<<

                    From Jeff
                    >They have appealed but its still misdeamoner charges so they wont get past the state apeals board which is a 3 judge panel I Believe. Evidence speaks better then the witnesses did. <

I AM CRAZY WITH JOY FOR THE JUDICIAL SYSTEM. I HOPE THE HEYDON'S ARE FEELING THE FEAR THE POOR HORSES HAD INFLICTED ON THEM.

Horseinc, Dorinda told me the same, 6 years, and I started another thread, sorry. I talked to Dorinda personally, and she said felony convictions. Can you please look at the Heydons guilty thread? Someone has posted that they only got less than a year! I sure hope Dorinda is right. Dorinda said felonies and an "appellate jury" which is very confusing.

                        Also being tried in GA?

Is it true that the Haydons are also being tried in GA, where 2 of the horses were purchased, as a felony crime?

                          The Sentences

Animal cruelty is a misdemeanor offense in MT, not a felony.

Craig Heydon received 10 guilty counts, fines totaling $5850, and 300 days in jail (much longer term with all but 300 days suspended).

Curtis Heydon received 11 guilty counts, fines totaling $6435. and 330 days in jail (much longer term with all but 330 days suspended).

Restitution was ordered to the Bitter Root Humane Assoc, amount still to be determined.

And most importantly - they forfeit all 4 horses. Horses are currently all under foster care and we believe all foster parents want to keep them.

Don't forget to add the expense of the transportation and defense lawyer to the cost to the scum bags. The 3 day trial probably cost them another $20-40K on top of the fines. The appeal will cost then even more. As long as it comes out of their pockets its punishment.

Thanks for clarifying. I wish it had been 11 and 10 felony counts instead of misdemeanors. The nice reporter I talked to was a horse reporter, not a crime reporter, and I guess she didn't know the actual criminal info.
Rat! I wanted felonies and jail time. Time for Montana to change its laws to reflect the level of animal cruelty involved in cases such as this. This wasn't neglect it was "attempted murder".

Meanwhile, everyone send an "attaboy" letter on each of the following to his boss:

First letter to: Sheriff, Ravalli County
                                205 Bedford Street, Suite G
                                Hamilton MT 59840

one letter "on" each of these deputies, can be in same envelope, but need to be separate letters for putting into their personnel files to contradict the complaints they get when they enforce traffic laws (maybe no speeding in MT but there was that drunk driver on the horse case):

                                Deputy John Moles
Dep. Moles testified at the trial. He is not only a deputy, he packs horses back into the mountains, and is an expert on horses and on backpacking. He testified that he had spent weeks with horses in the mountains, and that the 2 defendants did not take care of these horses and should have walked them back out of the wilderness when they first starting looking bad. He is the deputy who was called by Dep. McEldery to evaluate the horses.

                                Deputy Travis McEldery
Dep. McEldery testified at the trial. He talked to the defendants and recorded their answers to his questions about the horses. He called in Dep. Moles for consultation and evaluation and would not release the horses or the defendants.

the prosecutor is and will be on appeal, John Bell, Assistant County Attorney,
so the 3rd letter should be to:

                                Ravalli County Attorney
                                205 Bedford Street, Suite C
                                Hamilton MT 59840

reports are that John Bell did a good job prosecuting the case, plus he had increased the counts from the first 4 or so to 11 for one heydon and 10 for another.

Altho the judge supposedly reamed the 2 heydons in his sentencing speech, he didn't give them consecutive 12 month sentences, rats, but if you wish to write to him it's:
                                Hon. Jim Bailey, Judge
                                Ravalli County Justice Court
                                295 Bedford Street, Suite F
                                Hamilton MT 59840

I'm worried that with misdemeanor convictions, the defendants might decide to come back to GA and skip bond. Harder to get someone to extradict someone for misdemeanors than for felonies, and rats, now they are not convicted felons. Rats.

Not fair. Those 2 women worked so hard to rescue the horses, the deputies and DA did their jobs, and then the judge wouldn't pop them with consecutive jail time. And if they pay all the expenses, the 2 heydons will walk out free as birds, to do it again.

Do they deserve more prison time? Yes, in my opinion. But if they were sentenced to years in prison, that would be more likely to be overturned on appeal. They could end up looking like "victims" of "those crazy animal people".

As long as the punishment is severe enough to make other potential abusers sit up and take notice, I am OK with it. Again, I think these people deserve more punishment, but greater good may come from not "taking it to the max". The judge may be doing us a favor -- he may be very aware of what an appeal court will accept. Ten months in jail, the costs, and the negative publicity are significant enough to put other people on notice, IMHO, without risking a complete overturn on appeal.

To show how confusing the reports are, go to yesterday's issue, www.cherokeetribune.com where the paper reported that the Heydons killed the 4 horses. The headline, unless they have changed it online, says "heydons guilty in death of 4 horses"

I send the article to DGRH to post if she is online. I almost want the Ctribune story to stay up, as the horse owners in N. Ga might go get the Heydons.
