Forum rules and no-advertising policy

As a participant on this forum, it is your responsibility to know and follow our rules. Please read this message in its entirety.

Board Rules

1. You’re responsible for what you say.
As outlined in Section 230 of the Communications Decency Act, The Chronicle of the Horse and its affiliates, as well Jelsoft Enterprises Ltd., the developers of vBulletin, are not legally responsible for statements made in the forums.

This is a public forum viewed by a wide spectrum of people, so please be mindful of what you say and who might be reading it—details of personal disputes are likely better handled privately. While posters are legally responsible for their statements, the moderators may in their discretion remove or edit posts that violate these rules. Users have the ability to modify or delete their own messages after posting, but administrators generally will not delete posts, threads or accounts upon request.

Outright inflammatory, vulgar, harassing, malicious or otherwise inappropriate statements and criminal charges unsubstantiated by a reputable news source or legal documentation will not be tolerated and will be dealt with at the discretion of the moderators.

Credible threats of suicide will be reported to the police along with identifying user information at our disposal, in addition to referring the user to suicide helpline resources such as 1-800-SUICIDE or 1-800-273-TALK.

2. Conversations in horse-related forums should be horse-related.
The forums are a wonderful source of information and support for members of the horse community. While it’s understandably tempting to share information or search for input on other topics upon which members might have a similar level of knowledge, members must maintain the focus on horses.

3. Keep conversations productive, on topic and civil.
Discussion and disagreement are inevitable and encouraged; personal insults, diatribes and sniping comments are unproductive and unacceptable. Whether a subject is light-hearted or serious, keep posts focused on the current topic and of general interest to other participants of that thread. Utilize the private message feature or personal email where appropriate to address side topics or personal issues not related to the topic at large.

4. No advertising in the discussion forums.
Posts in the discussion forums directly or indirectly advertising horses, jobs, items or services for sale or wanted will be removed at the discretion of the moderators. Use of the private messaging feature or email addresses obtained through users’ profiles for unsolicited advertising is not permitted.

Company representatives may participate in discussions and answer questions about their products or services, or suggest their products on recent threads if they fulfill the criteria of a query. False "testimonials" provided by company affiliates posing as general consumers are not appropriate, and self-promotion of sales, ad campaigns, etc. through the discussion forums is not allowed.

Paid advertising is available on our classifieds site and through the purchase of banner ads. The tightly monitored Giveaways forum permits free listings of genuinely free horses and items available or wanted (on a limited basis). Items offered for trade are not allowed.

Advertising Policy Specifics
When in doubt of whether something you want to post constitutes advertising, please contact a moderator privately in advance for further clarification. Refer to the following points for general guidelines:

Horses – Only general discussion about the buying, leasing, selling and pricing of horses is permitted. If the post contains, or links to, the type of specific information typically found in a sales or wanted ad, and it’s related to a horse for sale, regardless of who’s selling it, it doesn’t belong in the discussion forums.

Stallions – Board members may ask for suggestions on breeding stallion recommendations. Stallion owners may reply to such queries by suggesting their own stallions, only if their horse fits the specific criteria of the original poster. Excessive promotion of a stallion by its owner or related parties is not permitted and will be addressed at the discretion of the moderators.

Services – Members may use the forums to ask for general recommendations of trainers, barns, shippers, farriers, etc., and other members may answer those requests by suggesting themselves or their company, if their services fulfill the specific criteria of the original post. Members may not solicit other members for business if it is not in response to a direct, genuine query.

Products – While members may ask for general opinions and suggestions on equipment, trailers, trucks, etc., they may not list the specific attributes for which they are in the market, as such posts serve as wanted ads.

Event Announcements – Members may post one notification of an upcoming event that may be of interest to fellow members, if the original poster does not benefit financially from the event. Such threads may not be “bumped” excessively. Premium members may post their own notices in the Event Announcements forum.

Charities/Rescues – Announcements for charitable or fundraising events can only be made for 501(c)(3) tax-exempt organizations. Special exceptions may be made, at the moderators’ discretion and direction, for board-related events or fundraising activities in extraordinary circumstances.

Occasional posts regarding horses available for adoption through IRS-registered horse rescue or placement programs are permitted in the appropriate forums, but these threads may be limited at the discretion of the moderators. Individuals may not advertise or make announcements for horses in need of rescue, placement or adoption unless the horse is available through a recognized rescue or placement agency or government-run entity or the thread fits the criteria for and is located in the Giveaways forum.

5. Do not post copyrighted photographs unless you have purchased that photo and have permission to do so.

6. Respect other members.
As members are often passionate about their beliefs and intentions can easily be misinterpreted in this type of environment, try to explore or resolve the inevitable disagreements that arise in the course of threads calmly and rationally.

If you see a post that you feel violates the rules of the board, please click the “alert” button (exclamation point inside of a triangle) in the bottom left corner of the post, which will alert ONLY the moderators to the post in question. They will then take whatever action, or no action, as deemed appropriate for the situation at their discretion. Do not air grievances regarding other posters or the moderators in the discussion forums.

Please be advised that adding another user to your “Ignore” list via your User Control Panel can be a useful tactic, which blocks posts and private messages by members whose commentary you’d rather avoid reading.

7. We have the right to reproduce statements made in the forums.

Update on Montana "Horses left for dead" trial

    More from court on Tuesday

    It seems the trail will last until Thursday ior Friday. I think the Heydon's are testifing today. They are pleading ignorance of horse care, even though the oder Heydon told me he grew horses and knows all about them. (But he told me he had NO NEED for them after the ride) He said he would return them to me better than I adopt them to him. NOT! 'cause there was no way I would let him adopt a cockroach!

    It was another good day for the home team! We heard a TON of excellent testimony from several people. Sooooooo these are the highlights from the 14 pages of notes I took….



    First was Shawn Shitell (? on spelling…I’m hooked on fonics) He worked on the FS trail crew. And reported to his boss that the Heydons horses were in poor condition and they were “ill prepared” for their wilderness adventure. He testifies that there is very little forage at that elevation for horses but “if horses are hungry, they’ll eat anything.” Elder Heydon reported to him that “the horses had taken a tumble a ways down the trail.” Hhhhuuummm…I wonder what happened. If the horses could only talk…



    Then we hear from Deputy Moles. He was FANTASTIC! He did not give an inch on cross examination…not even a little bit. He’s been in law enforcement for 7 years. Spent 8 yrs on a hunting ranch and has always owned horses and spent 3 yrs packing. He said the horse sores were from ill fitting equipment and not enough padding. He testified that their feet were so sore that none of them wanted to take a step. The hooves had been trimmed improperly and the shoes had just been haphazardly nailed on without proper fitting. He said that “they didn’t just get that way overnight…but it was from day after day after day after day of continuous use and he said to use a horse in this manner was TORTURE! He said it was a “total disregard for the health and welfare of an animal and that they were definitely abused.” He could not have been any clearer when he testified: “They should have left their equipment in the woods….walked the horses out…and taken them immediately to a vet. He also said” they’ll eat their own dung sometimes before they’ll eat bear grass”. He said it was a gross deviation of appropriate care for the horses. And on cross examination he was able to report to Haydons attorney that he has packed 100’s of horse into the wilderness. He did not cut them one inch of slack. He is our hero and he deservers out thanks and our respect. He demonstrated himself as a knowledgeable horseman today! And you would all be proud of him.



    Next we had Dr Andy Cross testify. He evaluated 1 horse, Diamond, on Aug 4th. Reading straight from his report he said the horse was “literally skin and bones.” “He was 150 -200 # underweight.” “He had pressure sores on his withers and a second sore at the base of his spine or the back of a saddle.” “He had a veracious appetite for green grass.” “He asked the Heydons how long it had been since the horse had worn a saddle to which they answered “30 days.” Interestingly, it was a friend of Dr Cross’s who referred the Heydons to Dr cross in the first place when he ran into them at the trail head …and he reported to Dr Cross that the horse was saddled at that time…less than 48 hours prior. Huuummm…caught in another lie. Dr Cross agreed that the horses had been neglected and not received proper nutrition.



    Then came Dr Gleason’s testimony. I’m proud to say THAT’S MY VET! Another hero for the home team! Ha gave a lot of powerful testimony but some of the highlights were…Q. “Dr Gleason…did you work any miracles for these horses?” To which he responded…”No, not really. I gave them pretty basic care and I made sure they were fed and watered.” Yeiks! Can it really be so easy? You mean you just need to feed and water a horse to keep it healthy?! And then when he was asked if he felt the horses care was a gross deviation from care necessary to sustain a horse comfortably…blah…blah…blah…some fancy words that are used in the statue….Dr Gleason said “If there is something stronger than a gross deviation…that would be my choice.” It was great…and it was powerful…and he didn’t mince words.



    Then Bill Goslin testified. He works for the FS. He had interaction with the Heydon on 2 occasions and multiple phone calls with them. He saw the condition of their stock. He tried to educate them about proper packing techniques. I don’t know…I wasn’t there…but it really seems to me that the FS Rangers should be required to enforce proper care and humane treatment of the animals in the back country. Seems to me like a ball was seriously dropped here. Opportunity presented itself…but was not taken.



    Then we heard Char Springer from the BRHA give a short testimony about the condition of the horse when they were checked in. A repeat of earlier info….Very sore feet, rub and raw places from ill fitting equipment, ulcers in eyes. Body scale 1.5. She was asked if the Heydons had ever offered to help with the costs associated with keeping and re habing the horses. The answer was “No.”



    Then we heard from Dr Brophy who was an impartial vet who had not actually treated the horses but evaluated the case based on the pictures and records from the different vets that had directly examined the horses. He said “I’ve never saw that much injury AND debilitation in one group of horses.” He said “absolutely the horse were malnourished.” He said it was a “Gross Deviation…blah, blah...” He said the blood work indicated that Able was suffering from “Severe tissue damage” He said he was available to treat animals in the wilderness and that he has done it quite a bit of it in the past. He said “The poor condition was caused fro over word and malnutrition.



    The prosecution rested at 3 pm.



    AND THEN CAME THE TESTIMONY DR. DICK RICHARDSON. I guess I’ll need to apologize to any of you who use him for a vet…but my gracious sakes alive….Dick Richardson should run for some office…because the only other time I’ve ever heard more double speak is when it’s coming out of the mouth of a politician! That man was something to watch and listen too! One minute he was ripping Dawn Merrill to shreds for bringing the horse to him on a Sun night when “all she was concerned with was punishing those terrible men and they would never get there horse back” and then the next minute he’s saying what a wonderful job she did in taking care of the horse. His main interest on Sun night was “how the horse would be disposed of”. His words and I quote. He kept referring to the Horses…when all he ever saw was ONE horse…Able. He said he wasn’t that bad off…but yet he “Fed the horse himself because he didn’t trust his staff to feed him properly” he miss quoted Dr Cross and put words in his mouth that he simply didn’t say. He totally threw Dr Gleason and the BRHA under the bus claiming that the way they re introduced feed was to blame for ALL Ables problems. He said that the grass gains nutritional value the higher you go…when everyone else testified to the opposite. He was kind of forced to make some statements that ultimately helped us. “Most people who use their horses hard, shoe them.” “Most people who pack in to the back country anticipate needing extra shoes” “No good cowboy would want their horse to look like that”: Then he was asked if he was biased against the BRHA…and he said “no, definitely not.” Then Attorney Bell asked him if he remembered leaving him a message on his voice mail Aug 29th. It said “ Hi John, this is Dr Dick Richardson. These guys from GA don’t deserve felony charges. The Human Society people are worked up into frenzy and they need to have their wings clipped.” Then when he was asked “Do you feel the defendants cared for Able in an appropriate manner?” He said “I don’t have enough information to make that determination. But then Atny Bell read him his very own quote from a newspaper article published in the Missoulian back in Aug which stated something to the effect “ I don’t think the horse is terminal and I think he will survive…but it is obvious that he suffers from over use and malnutrition.”



    Yeiks and double yeiks! We were all kinda scratching our heads and going….What ?????



    Please forgive any spelling errors and grammar mistakes and I’m sorry if this is a bit hard to follow. My brain is racing and I just wanted to get as much info out to you as I could tonight!

      Dr Dick Richardson

      It seems Dr Dick Richardson was on local MT TV and angered many folks. I heard he had many 'not so friendly' calls left for him from horse lovers and just people who care and disagree with his testimony of saying the horses were not abused or malnourished.

        Get a 3rd rope and hang Dr. Richardson along with the 2 Heydons
        Thanks for the updates, Cheryl. Sounds like all the men except that one are testifying to abuse, which is great, so that the defense cannot make it into an hysterical women defense. Good work by all the women and men who rescued the horses.

        AND YOU ARE RIGHT: If everyone will send "attaboy" letters, yes, slowmail, to the appropriate superiors, like if it's the deputy, you send to the sheriff, and if it's another agency, just put director or supervisor or something, saying what a great job the guy (name the guy of course) did in rescuing the horses and also in testifying professionally at the trial, this will help.
        Why? cause it will inspire the guys to do it again. And it will compensate for the complaints cops get when they are doing their jobs. One young uniform officer in Atlanta framed my letter on a murder case, it was his first attaboy letter, and years later when he was a Sgt., he told me that. On bad days, the cop can remember that some people appreciate good work, while speeders complain when they are given a ticket.

        OK, the witnesses and DA are doing their jobs, now let's hope the jury and the judge do theirs.

        Thank you Cheryl and thank your reporter. And thank God you did not fall for their ploy when they tried to get some of your horses. It's ironic that our GA horses, probably sold very cheaply here, had to be saved in Montana.

          I'll be happy to send letters if I can get the appropriate contacts.

          If Dick Richardson was my vet I would fire him on the spot and send a certified letter stating why. OMG.

            This idiot vet does enlighten me to something though. I always wondered how people with horses in a really horrible state that do use a vet manage to get them there with the vet coming out and doing shots or such. Well this type of vet is how it happens. The clueless type vet.

                I'll try to get Dorinda Troutman to give us the info after the trial is over. I haven't heard from her since this started Tuesday, since they are on mountain time and she's in court.

                Oh for the old days, even before my time. One old GA case, not horse related, is reported in the law books as during a trial, someone in the audience in the courtroom shouted 'get a rope". I think they should take the Heydons out and hang them, after a fair trial of course. And let the rescued horses watch.

                  Waiting for verdict

                  Dawn just called. Court is over and they are waiting for a verdict, hopefully tonight! If they don't decide by 9 MT, they will come back tomorrow but she said it looks like it will be tonight.

                  The older Heydon took the stand and said the horses were skinny when he got them, there was nothing wrong with them then or now. He did nothing wrong. The son said very little.

                  When they were talking with me about adopting, the father did all the talking. The son only said a few words, he stood back. It makes me wonder what kind of relationship they have. The son is the one who left the horse, Able, behind without any concern soooo.

                  Anyway, it may be in the wee hours when we get the news.

                  If Dorina gets word soon, please post!

                        Waiting for a guilty verdict. Presumably this is a jury trial? Why so long for the verdict, they must not be unanimous, which is a real issue.

                              For those who haven't listened at the jury doors (with the defense lawyers and deputies): some jurors will go in and refuse to talk; some jurors want to go thru all the evidence in detail; some jurors want to critique the DA or defense lawyer; and sometimes they just argue and disagree, and then after a while the judge gives a "dynamite" charge, the "Allen charge" named after the fed. case, and this charge tells the jury to try to agree.
                              And sometimes there's one or more jurors who hae an agenda, and they cause mistrials in "open and shut" cases like this one.
                              So hope that the jurors are just pokey. Or like one I had, when they went in and voted guilty, they decided to sit around a few hours so they wouldn't seem too fast. I hated the mistrials almost as much as the not guilties, but a mistrial can be retried till the cows come home. Usually only takes the 2nd trial but I hope that won't be necessary.
                              Jurors don't always tell the truth during voir dire, and those with agendas, like if someone on the jury thinks the younger Heydon looks like his/her son, will hold out. Other jurors will snitch on them too. Much of jury trial work is whether the jurors "like" the state and its witnesses or whether the jurors "like" the defense lawyer and his witnesses, and usually this has nothing to do with the facts, unfortunately.

                                Let's just say there's a reason why people around here call him Dr. Dick. He has a reputation for being a real A- hole. (Seems he's out to completely ruin his own reputation)
                                He specializes in equine AI and reproduction I believe- but I wouldn't use him if he were the last vet left in Montana!

                                  Well, it's after 9 AM in Montana so hopefully, soon a good verdict.
                                  I think the jury is 3 men, 3 women.

                                  Yes, what makes a jury decide? Only each person knows but fairness is not always in play.

                                  Fingers crossed.

                                  Dawn said the Heydon's said they love animals..
                                  Heydon testified (under oath, of course) that the horses only went 5 miles in two months. Dawn aid the day she found Able, he had travelled 17 miles in one day and Magic travveled 23. I don't have a horse here that can travel 5 miles without being exhausted!

                                  They said the horses looked like that from Day !...then why would you take skinny horses, duh!

                                  Heydon said Diamond had maggots on his saddle sore so he poured alchohol on it to get the maggots out, OUCH!

                                  They testified that the horses went down 15 -20 times in 2 months.......either on their own accord (refusing to walk anymore) or fallen.

                                  Dawn has ridden humdreds of hours out there and NEVER had a horse go down. WHY CAN'T THEY UNDERSTAND IT IS WRONG!

                                          Goodness.
                                          A good horseman doesn't have to tell anyone...the horse already knows.
