Forum rules and no-advertising policy

As a participant on this forum, it is your responsibility to know and follow our rules. Please read this message in its entirety.

Board Rules

1. You’re responsible for what you say.
As outlined in Section 230 of the Communications Decency Act, The Chronicle of the Horse and its affiliates, as well Jelsoft Enterprises Ltd., the developers of vBulletin, are not legally responsible for statements made in the forums.

This is a public forum viewed by a wide spectrum of people, so please be mindful of what you say and who might be reading it—details of personal disputes are likely better handled privately. While posters are legally responsible for their statements, the moderators may in their discretion remove or edit posts that violate these rules. Users have the ability to modify or delete their own messages after posting, but administrators generally will not delete posts, threads or accounts upon request.

Outright inflammatory, vulgar, harassing, malicious or otherwise inappropriate statements and criminal charges unsubstantiated by a reputable news source or legal documentation will not be tolerated and will be dealt with at the discretion of the moderators.

Credible threats of suicide will be reported to the police along with identifying user information at our disposal, in addition to referring the user to suicide helpline resources such as 1-800-SUICIDE or 1-800-273-TALK.

2. Conversations in horse-related forums should be horse-related.
The forums are a wonderful source of information and support for members of the horse community. While it’s understandably tempting to share information or search for input on other topics upon which members might have a similar level of knowledge, members must maintain the focus on horses.

3. Keep conversations productive, on topic and civil.
Discussion and disagreement are inevitable and encouraged; personal insults, diatribes and sniping comments are unproductive and unacceptable. Whether a subject is light-hearted or serious, keep posts focused on the current topic and of general interest to other participants of that thread. Utilize the private message feature or personal email where appropriate to address side topics or personal issues not related to the topic at large.

4. No advertising in the discussion forums.
Posts in the discussion forums directly or indirectly advertising horses, jobs, items or services for sale or wanted will be removed at the discretion of the moderators. Use of the private messaging feature or email addresses obtained through users’ profiles for unsolicited advertising is not permitted.

Company representatives may participate in discussions and answer questions about their products or services, or suggest their products on recent threads if they fulfill the criteria of a query. False "testimonials" provided by company affiliates posing as general consumers are not appropriate, and self-promotion of sales, ad campaigns, etc. through the discussion forums is not allowed.

Paid advertising is available on our classifieds site and through the purchase of banner ads. The tightly monitored Giveaways forum permits free listings of genuinely free horses and items available or wanted (on a limited basis). Items offered for trade are not allowed.

Advertising Policy Specifics
When in doubt of whether something you want to post constitutes advertising, please contact a moderator privately in advance for further clarification. Refer to the following points for general guidelines:

Horses – Only general discussion about the buying, leasing, selling and pricing of horses is permitted. If the post contains, or links to, the type of specific information typically found in a sales or wanted ad, and it’s related to a horse for sale, regardless of who’s selling it, it doesn’t belong in the discussion forums.

Stallions – Board members may ask for suggestions on breeding stallion recommendations. Stallion owners may reply to such queries by suggesting their own stallions, only if their horse fits the specific criteria of the original poster. Excessive promotion of a stallion by its owner or related parties is not permitted and will be addressed at the discretion of the moderators.

Services – Members may use the forums to ask for general recommendations of trainers, barns, shippers, farriers, etc., and other members may answer those requests by suggesting themselves or their company, if their services fulfill the specific criteria of the original post. Members may not solicit other members for business if it is not in response to a direct, genuine query.

Products – While members may ask for general opinions and suggestions on equipment, trailers, trucks, etc., they may not list the specific attributes for which they are in the market, as such posts serve as wanted ads.

Event Announcements – Members may post one notification of an upcoming event that may be of interest to fellow members, if the original poster does not benefit financially from the event. Such threads may not be “bumped” excessively. Premium members may post their own notices in the Event Announcements forum.

Charities/Rescues – Announcements for charitable or fundraising events can only be made for 501(c)(3) tax-exempt organizations. Special exceptions may be made, at the moderators’ discretion and direction, for board-related events or fundraising activities in extraordinary circumstances.

Occasional posts regarding horses available for adoption through IRS-registered horse rescue or placement programs are permitted in the appropriate forums, but these threads may be limited at the discretion of the moderators. Individuals may not advertise or make announcements for horses in need of rescue, placement or adoption unless the horse is available through a recognized rescue or placement agency or government-run entity or the thread fits the criteria for and is located in the Giveaways forum.

5. Do not post copyrighted photographs unless you have purchased that photo and have permission to do so.

6. Respect other members.
As members are often passionate about their beliefs and intentions can easily be misinterpreted in this type of environment, try to explore or resolve the inevitable disagreements that arise in the course of threads calmly and rationally.

If you see a post that you feel violates the rules of the board, please click the “alert” button (exclamation point inside of a triangle) in the bottom left corner of the post, which will alert ONLY the moderators to the post in question. They will then take whatever action, or no action, as deemed appropriate for the situation at their discretion. Do not air grievances regarding other posters or the moderators in the discussion forums.

Please be advised that adding another user to your “Ignore” list via your User Control Panel can be a useful tactic, which blocks posts and private messages by members whose commentary you’d rather avoid reading.

7. We have the right to reproduce statements made in the forums.
The Chronicle of the Horse may copy, quote, link to or otherwise reproduce posts, or portions of posts, in print or online for advertising or editorial purposes, if attributed to their original authors, and by posting in this forum, you hereby grant to The Chronicle of the Horse a perpetual, non-exclusive license under copyright and other rights, to do so.

8. We reserve the right to enforce and amend the rules.
The moderators may delete, edit, move or close any post or thread at any time, or refrain from doing any of the foregoing, in their discretion, and may suspend or revoke a user’s membership privileges at any time to maintain adherence to the rules and the general spirit of the forum. These rules may be amended at any time to address the current needs of the board.

    I feel terrible writing this, because exactly a month ago I posted about the great deals they were having, but it has to be done. It's easiest to just lay it out step by step.

    1. I placed a $200+ order. So not huge, but it's not like I ordered a hoofpick. March 20

    2. March 21 - I get the order confirmation, says in there and at the top of the website that most orders ship within two days.

    3. March 26 - I call because it's been a week since my order was placed, and I haven't heard anything about it. There's a "log in" on the website and all the order said was "In Process." The customer service rep says that they had recently reorganized their warehouse or something, and orders were taking a little longer. He assured me that it would ship soon.

    4. April 2 - The order is now marked as "On Hold" when I log in to check it. I try calling and no one answers, so I send an email, hinting at the fact that I'm kinda peeved it's taking so long to ship, and how it would have been nice for someone on THEIR END to contact me about the order being on hold.

    5. April 4 - I get an email from the customer service rep "Carol" telling me two items (out of my order of about seven things) are no longer in stock....can they refund my money for that, or replace them with something else? Within about an hour of the email being sent to me (smartphone), I reply back, asking if a few other things were in stock. I don't hear back.

    6. I try calling the 5th and 6th, get "no operators available."

    7. April 11 - I send an email saying "Umm, hi, get my last email? Are those substitutions available?" basically, and again hint that I'm peeved. I ordered things like fly masks and fly sheets, which I didn't need mid-march but do need mid-april.

    8. April 16th - I leave a message on their voicemail asking someone to call me about my order.

    9. April 19 - No response to my phone call, so I've now filed a dispute on my credit card and have sent them a polite-but-peeved email stating that the whole thing has been handled incredibly unprofessionally, and there was absolutely nothing in my order that requires it to take a month to even be shipped out. I also mentioned that I would be telling everyone about my bad experience, which is what I'm here doing now!


    I realize I was wayyyyyy too patient, but I didn't actually need the items at that point in time, one was a discontinued item I was thrilled to find, and the prices were really good, so I just kept my fingers crossed that the package would eventually make it to me and I'd cross them off my list of acceptable places to shop. But no prices or discontinued items are worth a MONTH waiting time to even get them shipped out, nevermind that I haven't been able to even speak to a living person at the company for weeks now...

    Blech.

    Just a warning to stay away from them. I had checked them out here on COTH before ordering and there wasn't anything negative about them to give me pause, but there is now!

    I'm pretty sure there is some credit card rules with Visa and MC that an online company can't charge your credit card until your order has shipped...

    If there isn't a law, there should be.

        Yup. They CANNOT charge you unless your item has been put into a box and onto a truck.

          Really?! I had thought that it was just industry standard, not a rule, but I was charged the very next day after I submitted my order.

            Well, there is no industry law, I don't think. But I'm pretty sure Visa and MC have regulations against this.

              I don't think it's a law that companies can't charge you right away, however I DO believe they have to state that policy right up front.

              I've bought from quite a few companies (just recently) who clearly state that my credit card will be charged as soon as I click on that "submit" button; others that clearly state I won't be charged until my item is shipped.

              Unless some law went into effect just this past week, I don't think there's any such a law other than possibly one re: policy disclosure.

                uh oh. I ordered 3 Amigo saddle pads ($ 16 ea!) from the same outfit 10 days ago. card charged (debit via payPal)
                supposed to ship in 1 - 4 business days via FedEx and I would get an email when they shipped.
                ... no email yet

                I just emailed them. thanks for the alert, GoForAGallop!
                (but Damn I want those pads!)

                  .... and just checked order history via the Login on their site
                  and there is a note ON HOLD. and "oos for whole order"
                  (oos means OUT OF STOCK)
                  All on the SAME DAY as I placed the order!
                  WTF?!?!

                  now I am calling


                  edited to add:
                  figured calling would be a total waste of time. so went right to the payPal site and disputed the charge and asked for an immediate refund

                          Companies cannot charge your card until the item ships. However, they can authorize the funds to cover their end. Once the item is packaged then they can capture the funds. The authorization may look like a charge on your end, but isn't (usually it says pending or authorized).

                            I must have 20 pads for horsey and THOSE damn things fit her better BY FAR than any others. I was psyched to find them for such a nice price. As noted above, I opened a PayPal dispute. And I emailed them. And I emailed them a link to this thread.

                              Are you sure? I'm not finding anything about that online. It says that that is "industry standard", not to charge before shipping, but that it's not illegal.

                              I was definitely charged. Not pending or authorized, which shows up different on my online account.

                                Yes, I believe that is correct.. I know that once I ordered something from Dover, and the customer service rep TOLD ME (unless he was mistaken) that they cannot charge for an item until it ships. Even if I place an order with Smartpak (which I do at least once a month), they will put a pending hold on my credit card, but it won't clear until the item ships - half the time it doesn't even clear until I get the box in my hand from UPS. I found this online, I understand it's Wiki Answers so may not be completely accurate, it does list another source though:

                                It is technically legal, but it isn't good business!! Most companies only charge when they ship. It is against VISA and MasterCard's regulations for a merchant to bill their cards prior to shipping.

                                Contrary to what some sources indicate, the Fair Credit Billing Act does not address if it is legal for a company to charge you before shipping the product. Instead, it makes it illegal to not ship within advertised time period (or 30 days if no expected shipping date is mentioned in the agreement). If a merchant says "this item takes 90 days to ship", then they may bill right away and not have a legal problem if they ship before the 90 day window.

                                  Correct. It's not a federal regulation, but it's in the Visa/MasterCard/Amex bylaws, which merchants must abide by or risk losing the ability to accept credit cards. (If they misbehave too much resulting in lots of chargebacks, their bank or processor will drop them.)

                                  [DH has been in the credit card industry for many, many years and I did my time as well. ]

                                      Goodness, this is a surprise. I've had nothing but good experiences with them, probably over half a dozen orders.

                                      I wonder if something has changed recently? I've not ordered anything from them in a few years.

                                      How disappointing.

I am less frustrated by the fact that I don't have my stuff than by the fact that I have called their line repeatedly, on different days of the week and different times of the day, and not been able to reach anyone for weeks. Nor will they respond to email. Very annoying and suspicious.
