That is a very good question. She would have to have a whole mountain of cash on hand.. because I can't imagine a lender that would approve a mortgage for someone with so many outstanding debts and active judgements.

I will check the county's grantor / grantee to see if she has recorded any deeds. At last check the last thing recorded with her name was a foreclosure deed.

Have you heard where the new ranch is (what county?).

32 mares on her "website". Another wow! Let's all HOPE she has a "bigger " farm than the recently auctioned off 3.3 acres she owned.

Well Hubby is also named on the mortgage that was foreclosed on, so no one is lending to him.

Maybe Jill has an invisible partner with a few million (you are not buying a farm in CA for anything less), sitting around to bank roll her breeding operation... willing to buy farms for her, but not willing to pay the vet or feed store resulting in Judgments?

It would be possible for her to apply for a loan for a new farm before she defaulted on the first mortgage. NOT saying this is what she did, just saying it is possible to do that, and I know someone who has.

She had been in default multiple times on her ranch before it went through foreclosure, which here in CA is at least a 3 month process.

Plus new lender would have to turn a blind eye to the outstanding judgments against her (which have been recorded, and would come up in any title search).

And approve her for two mortgages at once (because other farm was not for sale).

And she would have to have money stashed in some separate account... one different then the one she has been writing hot checks out of...

No idea in all of this but there had to be money at one time or from someone. She was already defaulting on things and still buying mares and stallions , I know she has gotten a few mares on payments a few free bee's and some on trade but for a bit she was buying up pretty high priced mares and a new stallion or two when people were already starting to complain about what they were owed

thanks everyone for all the PM's! i very much appreciate it!

heard back from a couple of the websites she posted my horse for sale on and they are looking closer into the matter! they just need to confirm it is the truth and i am providing them letters.

i tried to have someone go and actually see first hand if my filly was there, but Jill locked her front gates and the only way in was the climb through pastures and over fences......jill never locks her property to my knowledge.....i think she is worried!

i just want it to be known to everyone i have given her multiple chances. I've offered to even drop all my ranting in exchange for my horse. nothing. even after this whole post on the forum i still can't get in contact with her. geez!!

lets hope for good news from my lawyer on monday!!

It seems there is one avenue left untouched.

Please post a description and photos of your yearling on this thread,
and that will cast a very wide net !

And offer a reward for info that leads to the safe return of your yearling.

How scary is it that I guessed who the "buyer" was almost as soon as I opened the thread? And I don't even breed.

HOW in the name of all that is holy is this woman not behind bars?

Is she some kind of sociopath or has she just completely lost touch with reality? Or both?

OP, I hope you get your girl back soon.

While several people on this thread have suggested contacting the local police, the police consider this a civil, not criminal issue. In essence, JB is in breach of contract with you, which is different than if she literally stole your horse off your property. You entered into a sales agreement with her, and she didn't make payments as stipulated in the contract. While this is tragic, it's no different legally than someone who goes to the local car dealership and buys a car signing a contract to finance the car over time. If the buyer doesn't fulfill the contract, the police don't arrest the buyer. The car gets repossessed.

Since JB has evidently posted your filly for sale on the internet, make sure you print the ads or screen shots of your filly before asking the websites to delete them. They will come in handy as evidence if you go to court. You mentioned that you have contacted an attorney, which is good, because you will probably have to sue her for the return of your filly.

As for locating the filly, ask a friend to call JB about the ad and express an interest in buying the horse. If JB is planning on selling her, she will have to let prospective buyers look at her.

Please keep us updated on the return of your filly!

This is probably what I'd do. Have a friend call pretending to be a "buyer", and then show up for the appointment with a truck and trailer and load her up and go.

But that's just me - I have no legal knowlewdge or experience, and the standard disclaimer applies.
