View Full Version : Your expectation in similar situation?

Looking for opinions on a situation I'm currently dealing with. I am not going to name any names for professional reasons, please do not ask me via PM, phone call, e-mail etc... I will not respond.

Booked my mare to a stallion located in the US this spring, and have now had to book her to a new stallion as the original SO will not return my calls, e-mails or COTH PM's. Over the past 2 weeks, I've left 4 voice messages, 4 e-mails and 1 COTH PM which I think is reasonable for the time frame, not over the top demanding an immediate response.

My mare was ready for semen, and I obviously wasn't able to get semen from the SO as I can't get any kind of response. At this point, I don't know what to do, I've tried every method of contact I know how and I'm a country away!

I've spent a considerable amount of money getting my mare ready to breed to this particular stallion as the SO has specific pre-breeding requirements. My cost is in the neighbourhood of $500, not including ultrasounds to check her folicle etc...

Needless to say, I'm horribly disappointed, especially because I can see this person has been on COTH in between my e-mails, thus they must have internet access. Additionally, I've left 4 voice messages and it isn't possible that all of them have been lost. I've spent money and time getting my mare ready for semen, and I think it is terrible for a SO to show this kind of disregard with clients.

If faced with the same situation, what would you expect?

I would publicly out them. And would be be prepared to show anyone copies of my emails and have the Mod's here confirm I had sent pm's.

:yes::yes: I agree! If you've paid the stud fee and have made every attempt to contact them in the meantime...all the while, they have continued to post on here. That's fraud. I'd try and get a hold of them on here. The BB crew on here is wonderful with making people own up to their obligations! :yes:

Leave one last message on their voicemail, send them one last email and send them one last PM directing them to this thread and letting them know that you will expose them if they do not respond to you. Give them a time limit. That simple.

You could also mention that CoTHers are super sleuths and and some have pretty much figured it out already. ;)

It doesn't surprise me and I would out them immediately. I regret not outing my COTH scammer who had bad semen, knew it, and still kept collecting $$$. :mad:

I am pretty sure this particular SO has an excellent rep on this board, though...

Sorry to hear you went through hell, Amoroso. Breeding season is stressful enough as it is. :(

I wouldn't out them here but I would go see your DA about possible criminal charges. It's fraud, it's illegal and if the transactions crossed state lines it's a federal offense most likely either mail or wire fraud. I believe if more than $500 was involved it's a felony.

You could give them one last chance, telling them if you don't hear from them you will pursue both criminal and civil charges against them.

If you have a a lawyer you can CC that transmission to so much the better.

Send them a registered letter, demanding your money back immed. for services. Then out, them...... (like everyone else said if you dont have response, etc within a week).
Business is business and nice people in business dont get far............

If it's who I think it is (go deductive reasoning, go!), I'm also pretty surprised. Wonder what's going on there??

It must be the year for stallions named 'R' at Apex, eh? Good thing 2 will be Dutch, although F names are not that easy either :lol:

Before we virtually tar and feather the stallion owner, perhaps we should take into consideration there are two sides to every situation. We have only heard one.
Some folks seem to have technology issues, is it at all possible this may have contributed to the current state of things? OP is in Canada, maybe there were issues related to the CEM paperwork, etc...
Not making excuses, but with out the full picture, some of the comments may be a little over-reactionary.

I had some issue reaching one of my stallion owners, (They don't 'do' email much) and got a little freaked out, but was able to get things sorted out privately, and am now waiting on my 14 day check.

Sixlb, wouldn't you at least expect the SO to communicate with you about any issues or holdups that were occurring? I believe that this stallion owner is having a fairly busy season, but it's kind of bad form to be seen using COTH if you're not responding to business emails/calls.

Certainly there are always two sides of every story. However, it sounds like the OP has tried to contact the SO through a variety of avenues and the stallion owner in question is certainly internet savvy and posts on this board on a regular basis. Even if the SO is having issues with collecting the stallion or the new CEM protocols, the lack of communication with the mare owner is inexcusable. Unless the SO is in a coma in the hospital, there is no reason she cannot at least give a short response to the MO to let her know what's going on.

Yes, I would, and yes I do agree that the communication between both parties is very important. However, for me personally I would not rely on email or PM's to accomplish this. How does the contract say to reach the SO?
That would be my first method of contact, and I'd make a pretty strong effort, requesting conformation that my call/message/fax/whatever had been received. If I didnt receive conformation, I'd continue trying, then resort to other methods.
Is there a time frame stated that notice to ship is requested by? Do they want to know the week the mare is coming in, 24-48 hrs, etc?

The OP is from today at 12:49 AM, Pretty late, and no update to speak of.

All I am saying is that maybe the other party had some issues we are not in the know about, and yet folks are jumping to conclusions, and some pretty harsh things have been said and inferred.
There are details lacking on many levels, Maybe the two parties have made contact and things are OK now?

I too hope there is a resonable explanation but we do have details from the OP:

Sorry, this was me. Several people emailed me. I partially ruptured my achilles tendon and I'm on a LOT of pain meds I go in for surgery on Friday. I just missed it, it went to my bulk email and I forgot to look at the bulk. Let's face it I barely know my own name these days I'm on a vicoden high. I talked to the OP and hopefully she's happy with the outcome.

I am glad to read everything is under control!

I hope you recover quickly grayfox! I too was surprised by this post as you do have an excellent reputation...

Although, if I may, I think you need to invest in a replacement person in case accident happens and that is nothing personal, but something we should all think about doing! ;)

The intent of this thread was not to out the stallion owner, I hope that was clear enough in the beginning. In any event, I've spoken to Jill and given the circumstances what happened is understandable. She has additionally gone above and beyond to rectify the situation and make it worth my while to breed my mare next year instead. I think anyone could have ended up in the same boat given what happened....
